The Shade Store - Terms of Sale

Terms of Sale
All purchases must be paid in full at the point of sale. All window treatments or other products purchased from The Shade Store through the Site are custom made based on the customer’s specifications and measurements submitted to The Shade Store by the customer or a third party installer. The customer and/or third party installer, as the case may be, is solely responsible for such specifications and measurements and for the assembly and installation of the product. The Shade Store and its affiliates reserve the right to refuse service, terminate accounts and/or cancel orders in its sole discretion including, without limitation, if The Shade Store believes that customer’s actual or intended conduct violates applicable law, rule or regulation or any policy, term, condition or disclaimer set forth on this Site or is harmful to the interests of The Shade Store or any of its affiliates. All capitalized terms not defined herein shall have those meanings prescribed to them in the Terms of Use.


Cancellations, Returns And Exchanges
There are no changes, cancellations, exchanges or returns without the express written permission of The Shade Store (please know, if a credit is ever granted to the customer for a return or cancellation - there will be a 5% processing fee of the credited amount.)


Colors And Textures
Colors and textures may vary slightly from lot to lot on some styles and may not exactly match the sample book or previous purchases. The Shade Store periodically discontinues certain styles and colors. The Shade Store reserves the right to substitute discontinued products with the nearest color and/or style of product that is of equivalent or greater value. In addition, fabrics and materials tend to have dye lot inconsistencies which could also alter the appearance of a color. For wood materials (wood blinds and woven wood shades), please note that its natural composition may cause slight warping and/or fading over time as well as, variations in color and grain - all of which are considered normal characteristics.


Risk of Loss
The risk of loss and title for products shipped by or from The Shade Store pass to you upon The Shade Store's delivery to the carrier.


Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER THE SHADE STORE NOR ITS AFFILIATES SHALL BE LIABLE TO CUSTOMER FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING BUT NOT LIMITED TO LOST PROFITS), WHETHER ARISING UNDER CONTRACT, TORT OR OTHER THEORY OF LIABILITY, EVEN IF THE SHADE STORE HAS BEEN ADVISED OF THE POSSIBILITY THEREOF. IN NO EVENT SHALL THE SHADE STORE’S LIABILITY TO CUSTOMER HEREUNDER EXCEED THE AMOUNT THE CUSTOMER PAID TO THE SHADE STORE FOR THE PRODUCT.

SOME STATES DO NOT ALLOW THE EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
